Terms of use of arkit3d.com and general terms for the design services of ARKIT3D Creative Studio.
1. Acceptance
By using arkit3d.com, sending a brief or booking a meeting, you accept these terms. Each project is also governed by its approved proposal or quote, which prevails over these terms where they differ.
2. Services
ARKIT3D designs trade show booths, product displays, signage, print-ready artwork, playful marketing activations and experience concepts. Unless the proposal says otherwise, we deliver design, 3D visualization and production files; fabrication, installation, permits and set-up are the responsibility of the client or the supplier it hires.
3. Proposals, payments and approvals
- Quotes are valid for the period stated in each one. Prices are in the agreed currency and exclude taxes unless stated otherwise.
- Work starts once the deposit stated in the proposal is received. Final deliverables are released upon full payment.
- Each proposal includes a set number of revision rounds. Additional revisions or scope changes are quoted separately.
- Approvals given by the client in the portal (renders, artwork, measurements) are final for production.
4. Client responsibilities
- Review and approve measurements, copy, spelling, colors and data before production. Errors not flagged at approval are not ARKIT3D’s responsibility.
- Ensure it holds the rights to any logos, images, trademarks and content it provides, and hold ARKIT3D harmless from third-party claims over that material.
- Check technical, safety and installation rules with its fabricator and with the venue or show organizer.
5. Intellectual property
- Concepts, designs, renders, 3D models and files are works of ARKIT3D and protected by copyright.
- Upon full payment, the client receives a license to use them for the project and purposes agreed in the proposal. Full assignment of rights or editable source files beyond what was agreed are quoted separately.
- Proposals that are not approved or paid remain ARKIT3D’s property and may not be produced or used.
- ARKIT3D may show the project in its portfolio and social media once it is public, unless a non-disclosure agreement is signed.
- The DXR™ methodology, the Playful Marketing Collection, "Experience Architecture™" and the ARKIT3D and Snuube brands belong to their respective owners.
6. Timelines and cancellations
Timelines start when we receive the deposit and all required information. If the client cancels, work completed up to that point is invoiced; deposits cover work already started and are non-refundable unless the proposal says otherwise.
7. Limitation of liability
ARKIT3D’s total liability for a project shall not exceed the amount paid for that project. We are not liable for indirect damages, lost profits, or for the fabrication, installation or use of the designs by third parties.
8. Use of the website
- You may not copy, bulk-download or reuse the images, renders or 3D models on this website without written permission.
- Attempting unauthorized access to the website or the Snuube platform, introducing malicious code or submitting automated forms (spam) is prohibited.
- The client and agency portals run on the Snuube AI Workforce platform and are also governed by its terms.
9. Governing law
These terms are governed by the laws of the Dominican Republic. If you are a consumer, you keep any rights granted by the law of your country. Before any claim we will try to resolve the matter in good faith; failing that, the courts of Santo Domingo shall have jurisdiction unless applicable law provides otherwise.
